BIG WIN IN COURT.
A defendant's attorneys tried to get our lawsuit challenging Colorado’s 6.5% excise tax on self-defense hardware thrown out.
The judge DENIED the motion.
And the ruling matters beyond simply allowing this case to move forward.
The defendant's lawyers argued that plaintiff Magnum Shooting Center lacked standing. The court rejected that argument, holding that the threat of prosecution for refusing to comply with the law is sufficient to establish standing in this case.
That addresses an important standing question relevant to CSSA’s broader legal fight: Coloradans shouldn’t have to violate an unconstitutional law, get prosecuted, and only then be allowed to challenge it.
They tried to knock us out of court.
Instead, we defeated their motion and secured a favorable ruling on an issue that matters across our fight against Colorado’s anti-Second Amendment regulatory system.
Now we press the advantage.
