When you book a session with me to photograph your family and your children, I want you to pay close attention to my questionnaire and contracts.
This has always been included in my questionnaire and contract, but I’m making some more meticulous changes to both so there is a much clearer indication of your terms and preferences. I want to make sure that current clients booking again, as well as all future clients, truly pay attention to this section and clearly indicate their choice when it comes to sharing images of their babies.
Yes, this is my business. Yes, I love sharing my work. I love creating priceless images and I absolutely want to be able to show off the amazing photographs I create if your beautiful families.
But those are your babies.
Recently, a federal appeals court made a ruling about something that honestly made me stop and think.
The case involved a man who had AI-generated images depicting fictional children being sexually abused. The images did not show real children, but the court ruled that, because they were AI-generated and no actual child was involved in making them, there were constitutional protections around his private possession of those images inside his home. The ruling was very specific, and it does NOT mean that creating or sharing this material is suddenly okay.
But that's just it. Now AI can take an image of any child and create things that never actually happened and once a photograph is on the internet, you can't completely control it anymore.
That doesn't mean you shouldn't post pictures of your children. That's completely your choice. I post pictures of my own family too.
The internet is a very big, very dark place sometimes. Once something is public, someone can save it, screenshot it, remove little emojids and they can share it. Unfortunately, you can't control what someone else may choose to do with an image once they have it in their hands.
So I started thinking about it from the other side. If that were my child, and my photographer had a public photography page, would I want the choice of whether my child's face was posted for the entire internet to see?
Absolutely. Personally, my own profile is set to private to protect my children, but I never really considered their faces being shared publicly elsewhere. I’ll definitely pay closer attention to what I allow for my own children when I’m given the chance to decide.
And that's what I want for you.
I want to create beautiful photographs of your children. I want to be proud of my work. I want to share it when my clients are comfortable with that. But I never want you as a parent to feel like they have to allow me to post their child's face simply because they hired me.
So please, when you fill out my questionnaire and contract, slow down and pay attention to that section. Make sure you are clearly telling me what YOU want when it comes to your baby's images being shared publicly.
There is no wrong answer. I WILL follow your choice, Your babies. Your choice. Always.
