The Va**ng Association of Retailers is a membership-based 501(c)6 non-profit organization representing the interests of our industry, our members and their businesses.

Though we support all responsible retailers of to***co and va**ng products, “Primary Members” include brick-and-mortar retailers of to***co and va**ng products where persons must be at least twenty-one years of age to be allowed on premises. “Associate Memberships” and “Individual Memberships” are respectively available to other kinds of businesses and individuals who want to support the Association. San Francisco-style robbery costs Association member $200,000 in Gresham. Video shows it all. The Association declares its support for local police.

“In situations where the police are slow to respond, we don’t blame the police themselves. We blame the fact that our officers are stretched too thin, are not provided with the resources they need, are not given the political or legal support they need, and do not have sufficient support from local businesses. As a new Association, we know that police will do what they can. Police officers have our faith, confidence, and support.”

Ordinance 878 is unfair because it adds no new legal protections for children while curtailing the right of law-abiding adults to obtain and use products that are otherwise completely legal. It won’t work, isn’t about children, will carry terrible unintended consequences, and is fundamentally dishonest in that it is about controlling adults. https://bit.ly/3vEdqYF

VOTE "YES" ON Measure 34-314

A "YES" vote on Measure 34-314 would repeal Washington county ordinance 878 which bans the retail sale of flavored to***co and nicotine-based va**ng products inside the county. This ban is absolutely UNNECESSARY.

Proponents of the ban say they want to prevent kids from buying to***co and va**ng products but do not want to regulate adult choices. This is a demonstrable LIE.

Everywhere in Oregon, it is already illegal to sell to***co and nicotine-based va**ng products (flavored to not) to minors. In convenience stores and gas stations where minors can enter, these products are already kept out of customer reach, behind a counter or locked behind glass. Unless they are 21 years old or older, people cannot even enter dedicated va**ng stores as a customer.

If the concern is keeping minors from buying banned products, why ban the sale of affected products in dedicated va**ng stores where customers under the age of 21 can't even enter? If the concern is keeping minors from buying banned products, why aren't proponents also proposing bans of alcoholic products in convenience stores where minors can steal alcohol by simply opening a cooler and grabbing what they want?

State laws already exist prohibiting the sale of to***co and nicotine-based va**ng products to kids. Retailers support and obey these laws. They train their employees, violations are rare, and they fire employees on the rare occasions when violations take place. County-based regulation isn't necessary and could create new problems.

If 34-314 fails, confusion will reign as it will invite a checkerboard of different regulations and bans across different Oregon cities and counties. Adult use of affected to***co and va**ng products would still be legal everywhere, but selling them could be legal in one county, illegal in another, legal with some restrictions in another, and so on. It would be a mess, shows why we regulate such things at the STATE level, and the necessary state laws already exist and are being obeyed.

Do you want to help kids? Do you want to protect the rights of adults? Do you want a regulatory structure that is clear and understandable everywhere in Oregon? Our current laws are sufficient. Vote "YES" on Measure 34-314 and repeal Ordinance 878.

As has been seen with respect to alcohol in our history, banning otherwise legal and regulated products encourages the illicit manufacture and sales of more dangerous replacements. This only invites crime, reduces our quality of life, and diverts scarce police and public safety resources away from protecting us from violent crimes and property crimes. https://bit.ly/3vEdqYF

City-based and county-based regulations, like Washington county Ordinance 878, creates an inconsistent checkerboard of regulations across the state where certain products may be sold legally in one county, under certain conditions in another, or not at all in yet another county.

Regulation isn’t necessarily bad – we just need STATE-level regulation – not a checkerboard of county-based or city-based regulations. https://bit.ly/3vEdqYF

It is easier for a kid to steal wine or beer out of a convenience store cooler than it is for them to steal or buy to***co or va**ng products, yet Washington county isn’t trying to ban the sales of beer or wine. So how is this about kids? Again, sufficient laws exist and additional laws are not necessary. https://bit.ly/3vEdqYF
