How Do Courts Really Assess Property Contributions in Family Law Cases?

When a relationship ends, dividing property isn’t simply a matter of adding up who paid what.

Under section 79 of the Family Law Act 1975 (Cth), the Court takes a broader and more nuanced approach when assessing contributions. The decision in Barnell & Barnell [2020] FamCAFC 102 highlights that property settlements are not a mathematical exercise.

The Court may consider:
✅ Direct financial contributions
✅ Contributions to acquiring or improving property
✅ Indirect financial contributions
✅ Parenting and homemaking contributions
✅ Contributions to the welfare of the family
✅ Gifts and inheritances
✅ Contributions that helped preserve or grow the overall asset pool

Importantly, contributions don’t always need to be directly connected to a particular asset. A stay-at-home parent, for example, may have made significant contributions by caring for children and managing the household while the other partner focused on earning income or building a business.

The key takeaway: Your contribution cannot always be measured in dollars and cents. Courts look at the whole relationship, including the nature of the parties’ financial arrangements and their direct and indirect contributions.

The answer is yes, but only in specific circumstances.

A BFA may be challenged where issues such as these arise:

✅ Fraud or failure to disclose significant assets
✅ Duress, undue influence or pressure to sign
✅ Failure to meet important legal requirements
✅ Attempts to defeat or defraud creditors
✅ Major changes affecting the welfare of a child that may cause hardship
✅ An agreement that is void, unenforceable or impracticable to carry out

For a BFA to be legally binding, strict requirements apply, including independent legal advice for both parties.
