Bail approved by the courts. Was always going to be the case. AFP must be looking stupid right now believing he was a security risk… lol and this was the only argument by the AFP legal team. They must be a bright bunch of clowns.
All those years in the legal system to take to
take to the courts, your honour we believe Ben Robert’s Smith possesses a treat to leave the country. As such it is our opinion he should be denied bail.
Yes your honour, he did attempt to hand him self in to the AFP prior to his arrest with his legal team, and yes your honour, he did not resist arrest or attempt to deny the AFP the right to carry out thier actions.
But he is a grown man, has contacts that include family, friends, business members and politicians. So in our option Ben Robert’s Smith could be… again could be a flight risk.
I am housing at this point the fudge was lol I thier breath.
Bail, approved.
Now, let the games begin but this time BRS along with his legal team who have been ranked as the best in the southern hemisphere will have the upper hand.
Any legal argument status must be handed over between both teams.
The government will silently walk away leaving blame on the AFP and the AFP will indicate they followed the govements advise.
Either way, both the government and the AFP will look stupid in the eyes of most Australians.
Now with ANZAC on the door step the one day given in remembrance will be shadowed by this cluster f**k by the government and the AFP.
Funny is, no apology will come from them to the nation and those who lost their life’s for this nation and in support for others.
The first argument should be that this trail must be handed over to the War Crimes commission and away from any civilian management.
It is not a civil offence and never was. The AFP have stepped over the mark thinking it has powers to put in trail a military personal faded on a military war crime.
Let the international war crimes courts handle this and any other charges that should be laid against other service personnel such as, all senior ranks above the rank of corporal who engaged in the recommendation and approval of the orders to send service personal into the village in search of Afghan militants who did engage against Australian troops and kill by public executions of a soldier.
This will even go as high as the commander of the Australian forces. Yes section 28 of the Rome war crimes act clearly points this out and this is the war crimes act we are governed under.
