This photo is difficult to look atโbut it is a reality that every homebuyer and property investor should take seriously.
Recent events in Pampanga showed how powerful water can be.
Strong river currents eroded riverbanks and destroyed homes in Lubao. In another incident, a portion of a flood-control d**e in Minalin gave way, prompting evacuations.
๐ก BEFORE YOU BUY A HOUSE, CHECK THE LOCATION FIRST.
Donโt be impressed by the house alone.
Ask:

Is the property flood-prone?

Is it near a river, creek, canal, d**e or other waterway?

What is the elevation of the property compared with its surroundings?

Where does rainwater naturally flow?

Has the area experienced flooding in previous years?

Is there evidence of soil or riverbank erosion?

Is the property within a legal easement or restricted area?

What does the official zoning and hazard information say?

Can the road still be accessed during heavy rain or flooding?

What are the long-term flood-control plans for the area?

This is something many buyers are not aware of.
Under Article 51 of the Philippine Water Code (P.D. 1067), river and stream banks are subject to public-use easementsโgenerally 3 meters in urban areas, 20 meters in agricultural areas, and 40 meters in forest areasโand structures cannot simply be built within those zones. The Supreme Court has also recognized these restrictions.
Important: The applicable setback is not something a buyer should simply assume. It must be verified based on the propertyโs actual classification, location, riverbank/high-water mark and applicable regulations.
