The 2016 South China Sea Arbitration was an UNCLOS Annex VII arbitration between the Philippines and China. The Tribunal's Award of 12 July 2016 addressed maritime entitlements, historic rights, the legal status of features in the South China Sea, and China's activities. It held, among other things, that China's claimed historic rights beyond UNCLOS maritime entitlements had no legal basis under UNCLOS, that none of the relevant Spratly features could generate an EEZ, and that China had violated certain Philippine sovereign rights and environmental obligations. ๐Ÿ˜Ž๐Ÿ‡ต๐Ÿ‡ญ

UNCLOS is clear๐Ÿ˜Ž๐Ÿ‡ต๐Ÿ‡ญ๐Ÿ‘‰ the problem is Chinaโ€™s compliance, not the absence of a legal framework. As a binding treaty, UNCLOS establishes maritime entitlements, rights, and obligations that states are required to respect. China cannot simply disregard those rules when they conflict with its preferred territorial or maritime claims.

The issue is therefore not that UNCLOS needs to โ€œfixโ€ the situation. The law is already there; China must comply with it. Implementation means enforcing the rules not rewriting them to accommodate a state that rejects their legal limits.๐Ÿ˜Ž๐Ÿ‡ต๐Ÿ‡ญ
