The NFA Is Changing — Here’s What Oregon Gun Owners Need to Know
I’ve been getting a lot of calls and messages from customers asking what the recent federal court decision means for suppressors, SBRs, and SBSs here in Oregon.
Here’s what we know right now.
What happened?
In Silencer Shop Foundation v. ATF, a federal court in the Northern District of Texas ruled that the federal government’s justification for requiring NFA registration and approval of suppressors, short-barreled rifles, and short-barreled shotguns was undermined after Congress reduced the federal transfer and making taxes on these items to $0 through the One Big Beautiful Bill Act.
The court found that, with the tax reduced to zero, the government could no longer rely on the same Taxing Power justification for the NFA’s registration and approval requirements.
The court subsequently issued an injunction preventing the ATF from enforcing those NFA requirements against the plaintiffs and their customers/affiliates.
Important: This does not mean the NFA has been eliminated nationwide or that every gun owner in every state can currently transfer an NFA item without federal paperwork. The ruling is currently limited in its scope.
What does this mean for Oregon?
For Oregon, nothing has changed yet.
Oregon law specifically addresses possession of, SBR's, SBS's, and suppressors.
Under ORS 166.272, knowingly possessing one of these items is a Class B felony unless the circumstances fall within the statute's federal-registration provisions. Oregon law also provides that a person cannot be arrested or charged under that section when they have documentation showing that the item is registered as required under federal law.
Oregon State Police currently states that suppressors are legal to possess and use in Oregon, but that the necessary federal requirements must still be satisfied.
So, as of today, Oregon customers should continue to follow the existing federal NFA process when purchasing an NFA item through an Oregon dealer.
The fact that the federal tax is now $0 does not automatically mean that the federal registration process has disappeared for everyone, and the recent Texas ruling does not automatically change Oregon law.
Should you wait?
This is where things get interesting.
I’m getting asked whether people should hold off on buying a suppressor, SBR, or SBS because the federal government may eventually eliminate the NFA registration process.
There is certainly a possibility that the federal landscape could change significantly as a result of this case and the litigation that follows.
But there is another side to consider: state law.
Several states are currently looking at additional restrictions or outright bans on certain NFA items. I sincerely hope Oregon does not go down that road, but given the direction of Oregon's fi****ms legislation over the last several years, I personally would not assume that future restrictions are impossible.
That creates an interesting situation for Oregon gun owners.
Right now, the federal tax on these NFA items is $0, while Oregon continues to recognize possession of these items when the applicable federal registration requirements are satisfied.
If you have been considering purchasing a suppressor, SBR, or SBS, I personally would not wait solely in hopes that the federal government eliminates the remaining NFA requirements.
There is no guarantee that the federal process will disappear, and there is no guarantee that Oregon won't attempt to impose additional restrictions in the future.
At the moment, we are in a pretty favorable position: the federal tax is $0, and these items remain legal to own in Oregon when the applicable requirements are met.
Could that change? Absolutely.
Could the federal NFA registration system eventually be eliminated? It's possible.
Could Oregon attempt to restrict these items in the future? Also possible.
Nobody knows exactly where this is going yet.
This isn't a scare tactic or a sales pitch telling you that you need to buy something from us immediately. Buy from wherever you choose. I'm simply trying to give our customers and fellow Oregon gun owners some information about what is happening and why I've been getting so many questions about it.
As things develop, I'll continue to keep you updated.
