Hello Wyoming Va**rs!
I have to explain a few things today, for two reasons. First, you need to know this. Second, the date stamp on this post will work as evidence to the FDA that these products were on the market at this time.
Let me catch you up, in case you haven't been paying attention. The Obama administration gave the FDA regulatory authority over all to***co products, then they made the decision that v***r products are to***co products and FDA regulated us as though we were a new product coming on the market. The problem is they required the exact same science and paperwork that a new cigarette would require to come to market. Most of it doesn't apply to our industry, but they expect it anyway, so we did our very best to file the most complete Pre-Market To***co Applications (PMTA's) that we could. A lot of the science takes years to preform, which they didn't give us, but we submitted on time anyway, and asked for enforcement discretion while we finish up our testing. We jumped through every hoop, and either did, or were in the process of doing every little thing they asked for.
The FDA issued us a Market Denial Order (MDO) for every product we submitted without reviewing our science. They denied the to***co flavors and the flavorless, even though they shouldn't have. This gave me two options, I could cease production and file a lawsuit, which would cost a boatload of money, and effectively close the Wyoming V***r Company, or I could switch to a ni****ne not derived from to***co. At the time, the FDA did not have regulatory authority over To***co-Free Ni****ne (TFN); so we switched ni****ne, altered our flavors so that they tasted the same, and changed the name of the flavors. You may have noticed the TF at the end of the flavor name. For example, Vanilla Bean became Vanilla Bean TF, for 'To***co Free'.
Then the Omnibus spending bill came along. This is the most recent one that sent aid money to the Ukraine. In that bill was a provision to allow the FDA regulatory authority over synthetic ni****ne. On March 15th, at 1:00pm local time, the President signed that bill into law. By 1:30pm, the FDA was all over us like white on rice and a glass of milk and a paper plate in a showstorm. They had threatened fines and asset seizure within a half hour of the President's signature.
So now we are back where we were last year. I'm creating new PMTA's for the current products. Unfortunately they've stacked the deck even higher against us. We had three years to put our PMTAs together last time, and they were denied. As of right now we have been working on them for 20 days, and have about 70 days remaining. The products we will be registering are as follows:
