Unfortunately after speaking with legislators over the last few days, H**P IS STILL THREATENED! Please see the bill sponsor's recent Facebook post and leave a comment.

Legislation like HB98 will kill reputable small h**p businesses under the guise of "safety" and "ma*****na" when in reality if regulations on H**P (which is not the same as ma*****na) are what is truly desired, then let existing h**p businesses attempt to comply! The 2018 Farm Bill has already legalized h**p and its derivatives federally, and it provides a clear regulatory framework that HB98 blatantly ignores. The right to free enterprise shouldn't be stripped away from small businesses nor should their existing inventory become immediately criminalized and their years of investing in this industry be meaningless all so that a few fortunate people who were lucky enough to buy their way into a retail ma*****na license will have a stronger monopoly that will in turn will make h**p products cost a LOT more than they do now if they're only available at state-approved dispensaries who will charge a 15% tax.

Right now THC-infused beverages are sold in many restaurants, gas stations, and liquor stores across Delaware, but there are no clear regulations in place to protect consumers.

HB 98, which was released from committee this week, would change that by creating a safe regulatory and tax framework for these drinks. HB 98 would ensure that THC beverages are sold only in package stores (liquor stores) which guarantees age-verified sales, that THC content is capped at 10 milligrams per drink, and that all products are properly tested and labeled.

The bill also addresses the growing availability of h**p-derived THC edibles (at concentrations of THC higher than the naturally occurring level in h**p of 0.3 mg ) in gas stations and smoke shops by requiring these products to be sold only in age-restricted retail locations which will help keep these products out of the hands of young people.

Over the last several years, we’ve worked hard to get Delaware’s adult-use cannabis industry off the ground, and we passed the enabling legislation with the goal of creating a safe, well-regulated, and responsible system. HB 98 will make sure that the sale of these beverages and edibles complies with the spirit of that law and our efforts to create a safe legal market.

Update on HB98: it passed, on the condition that there will be amendments to remove the attack on h**p and focus on the bill’s intent - to regulate ma*****na beverages.

Small businesses that are doing their best to sell lab-tested quality h**p shouldn’t be forced out of business under the guise of safety concerns when we are capable of complying with any regulations that a marijujana dispensary would comply with - we shouldn’t be punished and have our rights to conduct business stripped away, nor should Delawareans be forced to pay roughly 50% more for the same h**p products WITH a 15% tax on top of that!

***Please share*** and urge legislators to support a free market with regulations, instead of voting to outlaw and allow only MJ dispensaries that will charge you a 15% tax to sell you these products. Please note this bill *appears* to pertain to alcohol but the ban on these h**p products in general is hidden within 😫
