Native Birds are protected by the Migratory Bird Treaty Act (MBTA). A few birds found in the US are legal to sell and buy because they are invasive meaning their origin is outside the US. Here is a European Nightjar. Completely legal to purchase and possess. It hunts at dusk and dawn catching insects with its tiny beak. In the case now and priced to find it a home soon!
