Suppressor Update — Let’s Roll With It…

If you haven’t seen the ATF Director’s recent post regarding suppressors, go check it out—it’s made me confident enough to explore the change. We’re going to move slowly here, but Trident Armory will begin accepting qualifying Silencer Shop orders for transfer on a Form 4473/NICS check effective immediately.

For now, this applies to transfers only. Please don’t walk in expecting to grab a suppressor off our shelf on a 4473 today. We have a bunch of suppressor inventory in stock, but none of our current inventory originated through Silencer Shop.

We will, of course, continue offering traditional Form 4 transfers. In fact, with how quickly Form 4s have been getting approved lately, I personally think that may still be the quickest and cleanest option for many customers—and it leaves fewer gray areas or questions down the road.

But we also understand that some customers simply do not want to go through the Form 4 process, and we’re going to provide an avenue for those customers through qualifying Silencer Shop purchases.

Regardless of which route you choose, if you’ve been thinking about buying a suppressor, I wouldn’t wait too long. Inventory is already moving quickly and some of the popular models are starting to disappear from our distributors.

We’re also going to continue exploring the GOA/member-coverage side of the ruling. We are not currently a GOA corporate member but we’re looking into that as an option.

For now, Silencer Shop gives us the clearest and safest avenue to begin offering the new process, so that’s where we’re starting.

Update on Suppressor Transfers

We’ve had quite a few questions regarding the recent Silencer Shop v. ATF ruling and whether Trident Armory will begin transferring suppressors on a standard Form 4473 without an ATF Form 4.

Our position has shifted somewhat since yesterday for one major reason:

Suppressors are still being transferred from distributors to dealers on ATF Form 3s.

That means those suppressors are still being registered to the receiving dealer in the NFRTR.

A central issue in this lawsuit was whether the federal government can continue requiring NFA registration under its taxing authority now that Congress has reduced the applicable NFA tax to $0. Given that, we’re disappointed that the current process still appears to rely on Form 3 registration when transferring suppressors into dealer inventory.

That creates an important unanswered question for us as an FFL/SOT:

If a suppressor is transferred and registered to Trident Armory on a Form 3, and we subsequently transfer that suppressor to a customer using only a Form 4473, what happens to that suppressor in the NFRTR?

Our A&D records would show that the suppressor was lawfully disposed to a customer, while the NFRTR could continue showing that same suppressor registered to Trident Armory.

That is an unresolved compliance issue we are not comfortable ignoring.

There is also still time for the federal government to appeal the decision. If the legal landscape changes after we have completed 4473-only transfers, we want to know exactly how ATF expects those previously transferred suppressors—and our NFA inventory records—to be handled.

Please don’t misunderstand our intention.

We support the ruling. We’re excited about where this may be headed, and we would love to see suppressor purchases handled like ordinary fi***rm transactions.

We simply want the compliance side to be clear before changing our transfer procedures. Protecting our customers and protecting our FFL/SOT have to come first.

Hopefully this issue is clarified quickly and we can move forward with our original intention of offering 4473-only Silencer Shop suppressor transfers.

The Silencershop vs BATFE case has been a popular discussion at the shop today.

For those not familiar, since there is no longer a $200 tax collected for some NFA items, Silencershop sued ATF saying there should not be a registry if tax is not being collected.

Silencershop won.

The district court stayed the injunction which is set to expire end of day today. No appeal or extension of the stay has been filed yet.

What does this mean? Theoretically all silencershop customers and GOA members will be exempt from having to file form 4s as of tomorrow, 8/13.

Do we expect any guidance from anybody?

Absolutely not.

Is it clear where this going from here?

Absolutely not.

It’s certainly got potential to turn into a giant can of worms.

How do we feel about it?

I asked for some help on a very simple clerical issue for a customer that’s been waiting on a can approval since 6/25. Roughly 45 days, most things are being approved in 2-8. I was very polite in my request.
