UNITED STATES—Proposed changes to the federal Section 106 review process could significantly affect how archaeological sites, historic places, cultural landscapes, and places of importance to Tribal Nations are considered when federal projects, permits, funding, or approvals are involved.

Section 106 of the National Historic Preservation Act requires federal agencies to consider effects on historic properties and give the Advisory Council on Historic Preservation (ACHP) an opportunity to comment before final decisions are made. The ACHP is now considering revisions to the regulations that guide that process. Preservation, tribal, and archaeological organizations are raising concerns about how the proposed changes could affect consultation, public participation, identification of historic properties, and efforts to avoid, minimize, or mitigate harm.

When regulatory protections are uncertain, private, nonprofit preservation like the Conservancy’s becomes even more essential—especially for sites that might otherwise be damaged before their full stories are understood. The public can follow the official process and comment if a proposed rule is published in the Federal Register.
