NFA UPDATE: WHAT THE RECENT RULING MEANS FOR NORTH CAROLINA SUPPRESSOR BUYERS — AUGUST 13, 2026
There has been a significant development involving the National Fi****ms Act (NFA) and the federal regulation of suppressors. With a lot of information circulating online, we want to clarify what this currently means for customers in North Carolina.
On August 5, a federal court ruled that certain NFA registration and approval requirements could no longer be enforced against the parties covered by the ruling after Congress reduced the federal making and transfer tax on suppressors and certain other NFA fi****ms to $0.
While this is a major development at the federal level, North Carolina law creates an additional issue for suppressor owners and purchasers.
WHAT ABOUT NORTH CAROLINA?
North Carolina General Statute §14-288.8 specifically regulates suppressors and provides an exception for possession when the individual is in compliance with applicable federal law, including the National Fi****ms Act.
Because North Carolina law is tied to NFA compliance, the federal court ruling does not automatically make suppressors a standard over-the-counter purchase in North Carolina.
For North Carolina customers, the existing NFA/Form 4 process should continue to be followed at this time.
WHAT ABOUT SBRs AND SBSs?
The federal court ruling also addressed Short-Barreled Rifles (SBRs) and Short-Barreled Shotguns (SBSs). However, North Carolina law separately regulates these fi****ms as well.
Therefore, North Carolina residents should not assume that SBRs or SBSs can now be purchased, manufactured, or possessed without the applicable NFA process.
BOTTOM LINE
This ruling represents a significant change in federal NFA law, but state law still matters.
For North Carolina suppressor buyers:
• The ruling does not currently mean same-day, 4473-only suppressor purchases in North Carolina.
• The existing Form 4/NFA process should continue to be followed.
• SBRs and SBSs should also continue to be handled under the existing NFA process in North Carolina.
• Additional court decisions, federal guidance, or changes to North Carolina law could change this in the future.
