The court ruling in regards to the NFA registration requirement for suppressors, SBR's, SBS and AOW's as unconstitutional, has created a conundrum for dealers. Some dealers that fall within the courts ruling, with legal advice, have moved forward with the transfer of those noted items on a 4473. Those items were more than likely already registered within the NFA system at the time of production. The transfer of those items without a Form 4, will more than likely result in what is considered a lost or stolen item during an ATF audit and can subject the FFL to a loss of their license. If you go to a dealer and expect only a 4473 transfer and the dealer says they still need to go through the NFA registration process, please understand that the dealers livelihood can be at stake for taking a risk - when there is no clear guidance from ATF on how to handle those registered devices. Be patient.....all this will settle out in time.

With the recent court ordered ruling that $0 taxed NFA items still required ATF approval as being unconstitutional, there are lots of questions that are still unanswered. 15 states have laws that point to federal approval for ownership of certain NFA items, which will more than likely still require a Form 1 or Form 4-until those state laws are rewritten or further court rulings are leveled. Those states are Alaska, Colorado, Connecticut, Georgia, Michigan, Mississippi, Montana, Nevada, North Carolina, North Dakota, Ohio, Oregon, Pennsylvania, Washington, and Wisconsin. There are still the banned states of California, Delaware, Hawaii, Illinois, Massachusetts, New Jersey, New York, Rhode Island, and Washington D.C-which get no relief.

This is the first positive step in rolling back the 1934 NFA act. There is still much work that needs to be done. We certainly see this as a win, but law abiding citizens should not consider this as acceptable. We must continue the fight to regain back our 2A rights. Please support those organizations that have spearheaded this legal battle.

The Supreme Court ruled today that ma*****na users cannot be banned from owning fi****ms. It had been that, if you noted on your 4473 Form when purchasing a firearm that you used ma*****na, you were not allowed to purchase a firearm. The supreme court ruled it as unconstitutional to ban the sale or possession solely based on use, with no proof that the individual is violent or has other mitigating factors that could lawfully prohibit the person from possession. I don't use, but I see that as a win and fully support that decision.

This is a step in the right direction. But, any regulation or law that restricts your 2A right to keep and bear arms is unconstitutional!

If you carry everyday for self defense, you owe it to yourself and others to be proficient in the tool you carry and a legal ‘expert’ for your state when that tool can be used. Put your face into your state laws and spend some quality time at the range with the intent of accuracy and gaining more confidence. Skills and knowledge degrade over time.

Form 1 submissions to ATF skyrocketed in January 2026, with the $0 fee for NFA items other than full auto fi****ms. Might be awhile to get these approved. Wait times for November 2025 were 533 days for paper filing and 6 days for electronic filing.
