We have received a number of questions regarding the recent Silencer Shop v. ATF decision and what it means for suppressors, short-barreled ri**es, and short-barreled sh****ns.
The decision is significant, and the DOJ has reportedly decided not to appeal. However, the practical compliance procedures for FFL/SOT dealers have not yet been clearly established by the ATF. The existing NFA regulations, NFRTR, eForms system, and ATF recordkeeping requirements have not simply disappeared because of the court’s ruling.
For that reason, we are not making any changes to our NFA transfer procedures until we receive clear guidance from the ATF. We will continue processing NFA transactions under the current procedures, including submitting required NFA paperwork, until ATF provides direction that those requirements are no longer applicable.
This is not a statement that we believe the court’s decision is insignificant. Quite the opposite, the decision could represent a fundamental change to the federal regulation of suppressors and other fi****ms historically regulated under the NFA.
Our responsibility as an FFL/SOT is to protect our customers and our business by making sure every transaction is conducted in accordance with the requirements the ATF is currently enforcing. We are actively seeking clarification from our ATF contacts and monitoring developments closely.
As soon as we have authoritative ATF guidance that allows us to transfer previously NFA-classified fi****ms through the ordinary fi***rm-transfer process, we will implement those changes and let our customers know.
Until then, please do not assume that a 4473 only transfer is currently available simply because of the court decision.
We appreciate your patience while this is being worked out. This could ultimately eliminate a substantial federal regulatory burden for both dealers and law-abiding fi***rm owners, but we are not going to put our customers or our FFL at risk by guessing at the ATF’s position before it has been formally clarified.
