To give an update on the NFA registration injunction: The current situation is very well stated here by another source in the industry.
8/18 Update: The new unconfirmed rumors are that the ATF will make comments today or Thursday.
As of this afternoon, every FFL we have spoken with is in the same holding pattern that we have found ourselves in. There are many questions that need to be answered before we can start releasing silencers without Form 4s. This afternoon's letter from the FPC to the DOJ contains some of the more important ones.
1. Will the Government be providing guidance to regulated entities and individuals on how it plans to ensure compliance with the injunction?
2. If the Government will be providing guidance, what form will it take, and when will it be provided?
3. Does the Government intend to continue enforcing the enjoined provisions of the NFA against entities or individuals who are not covered by the injunction?
4. If so, what will the Government do to ensure that it does not seek to enforce the enjoined provisions of the NFA against entities and individuals across the country who are covered by the injunction?
5. If the injunction is later stayed, modified, dissolved, or otherwise made ineffective, how will the Government treat NFA items made or transferred while the injunction was in effect?
Sadly, this means we are still in a holding pattern. The good news is we have already started selling silencers and running the 4473s that they will be released on, with all intention of releasing these cans in the next few days. Many customers do not have wait period exemptions and we hope to hand them their cans before their mandatory wait period is up.
Why the wait? It appears the ATF and FDLE were caught completely off guard by this ruling going unchallenged. No preparation and no plan. They have not told us that we can proceed and they have not even told us to hold.
What we do know is that the ATF and the NFA Division have not published comprehensive, transaction-ready instructions explaining how dealers, manufacturers, distributors and customers should implement the injunction.
Unless an FFL is operating through a documented procedure authorized by a protected plaintiff organization—and have confirmed that every part of the transaction qualifies—FFL's have to play it safe and continue the existing NFA process.
We don't like it any more than our customers. This is all we have been discussing all day since 8am and we can't thank you all enough for your patience.
