A letter circulating today states that Silencer Shop intends to complete two suppressor transfers in Texas without Forms 4 or ATF approval after the court's seven-day stay expires.

Here are the facts:

The letter was sent by Gun Owners of America, two proposed Texas transferees, and Silencer Shop CEO Dave Matheny to DOJ and ATF.

It provides notice of two specifically planned Texas transactions involving individuals who assert protection as both GOA members and Silencer Shop customers.

The letter asks DOJ and ATF to respond by 5:00 p.m. Eastern today if they consider the transfers unlawful or intend to continue enforcing the challenged NFA provisions.

This letter is not an ATF ruling, NFA Branch directive, court order, or nationwide authorization for dealers.

Do not release a suppressor without the currently required ATF approval.

Do not discontinue Forms 1, 3, or 4.

Do not promise customers a same-day or August 13 suppressor transfer.

Do not treat Silencer Shop's planned test transactions as authority for your dealership.

Continue all existing NFA, Form 4473, background-check, A&D recordkeeping, state, and local procedures.

Silencer Shop and the proposed transferees are intentionally testing the protection of a specific federal injunction under controlled facts. That does not mean every FFL or customer is protected. Acting prematurely could expose a dealer to federal enforcement, criminal or civil consequences, and adverse action against the FFL or SOT.
