New Update: New Jersey’s MSR/Magazine Ban Remains in Place for Now

Last week, NSSF sent an alert explaining that New Jersey filed a motion for a stay of the U.S. Court of Appeals for the Third Circuit’s mandate pending submission of its petition for a writ of certiorari to the U.S. Supreme Court. The Third Circuit granted the request for a stay. This means that New Jersey’s law remains in effect for now. The mandate will not issue until the U.S. Supreme Court disposes of New Jersey’s anticipated cert petition or until the time for filing such a petition has expired. Currently, New Jersey’s cert petition is due on October 15, 2026, assuming it does not seek an extension of time to file. If the U.S. Supreme Court were to grant New Jersey’s cert petition, then the stay would remain in effect per the Third Circuit’s order “pending the Supreme Court’s final disposition on the merits.”

NEW JERSEY SEEKS TO APPEAL THIRD CIRCUIT

AW / MAG BAN RULING TO U.S. SUPREME COURT

Requested Stay Could Put Favorable Ruling on Hold

July 31, 2026. Today, the New Jersey Attorney General asked the Third Circuit federal appeals court to pause (or “stay”) its July 17, 2026 ruling throwing out New Jersey’s longstanding “assault weapons” ban and magazine ban. If the Third Circuit grants the stay, New Jersey would still have to convince the U.S. Supreme Court to consider the July 17 ruling in order to keep the stay in place. If the Third Circuit denies the stay, New Jersey could make the same request directly to the Supreme Court.

Importantly, New Jersey’s request pauses (until the stay application is decided) the issuance of the appeals court’s “mandate,” which is the directive issued to the trial court to implement the ruling. For this reason, ANJRPC urges gun owners to wait until this stay application plays out in full before taking any action based on the Third Circuit’s excellent July 17 ruling.

With a Second Amendment-friendly majority on the Supreme Court, the question arises why New Jersey is seeking to appeal the Third Circuit’s ruling to the Supreme Court. The likely answer is, the issue is already headed there in unrelated cases from Illinois and Connecticut, as ANJRPC has previously reported. So New Jersey wants a seat at that table to try to influence the ultimate decision of the Supreme Court. New Jersey also is seeking to directly delay implementation of the Third Circuit’s July 17 ruling for as long as possible.

ANJRPC will continue to monitor, engage, and report to gun owners as this process develops.

We have been advised by the NJSP that full capacity magazines will be legal beginning on July 31, 2026.
We will be bolstering our inventory to accommodate anticipated high demand for the more popular fi****ms (G***k, S&W, Springfield Armory, AR's, etc.)
It is not possible for us to stock magazines for every firearm on the market. If you possess a less than commonly owned firearm, call the shop and let us know if you would like magazines ordered.
For those customers whom we are holding magazines, you can begin picking them up on Friday July 31, 2026 (ID required).
Any magazine that was modified by FMJ can be reversed for a small fee.
If anything changes, we will put out another notification.

Stop wasting our money on Violating our CONSTITUTIONAL RIGHTS!!!!!

Statement By Attorney General Davenport on Decision in ANJRPC v. Attorney General.

07/20/2026

🇺🇸 VICTORY IS OURS—NOW WE PROCEED PATIENTLY.
A TREMENDOUS VICTORY FOR NJ GUN OWNERS
Today’s Third Circuit ruling represents a major victory for New Jersey gun owners and could fundamentally transform several of our state’s firearm laws.

STANDARD-CAPACITY MAGAZINES
The court ruled that New Jersey’s 10-round magazine limit is unconstitutional. This ruling applies to magazines used in all fi****ms—including rifles, pistols and shotguns.

However, nothing changes immediately. We must wait for the court’s official mandate, which could take a few weeks, before we can begin selling standard-capacity magazines.

SEMIAUTOMATIC RIFLES
The court also ruled that New Jersey’s prohibited “evil features” restrictions are unconstitutional as applied to semiautomatic rifles.

These feature restrictions have not yet been resolved for pistols or shotguns and remain pending before the courts.

WHAT HAPPENS NEXT?

NJ Gun Lawyer Evan Nappen recommends remaining patient and taking no action for now. Although a stay may be unlikely, this is New Jersey, and we must continue to proceed cautiously.

We expect to have more information early next week. As soon as we receive reliable legal guidance, We will keep you informed.
