SUPPRESSOR UPDATE — PLEASE READ
We know a lot of you have been following the suppressor news, and our phone has been ringing with one question:
“The injunction went into effect at midnight. Can I come buy a suppressor on a 4473 today?”
The short answer at South’s Outpost is: Not yet — but hopefully very soon.
First, make no mistake: we are extremely excited about this ruling. This is potentially one of the biggest changes to federal suppressor regulation in more than 90 years, and we are looking forward to the day when purchasing a suppressor can be handled much like purchasing any other firearm.
However, there is an important difference between a court order taking effect and an FFL having clear instructions on exactly how that order is to be implemented.
As of today, some of the parties directly involved in the lawsuit have begun conducting qualifying suppressor transfers without a Form 4. At the same time, there are still unanswered questions regarding the scope of the injunction, who is covered by it, how dealers outside the named plaintiffs are supposed to process and document these transactions, and how ATF expects FFL/SOT dealers to handle their records.
We have not yet received sufficient, or any official guidance from ATF giving us a clear procedure to begin transferring our suppressor inventory on a standard 4473 alone.
South’s Outpost is a federally licensed fi****ms dealer, and our FFL is our livelihood. More importantly, we aren't going to put our customers in a questionable legal position just so we can say we were the first store in the area to hand someone a suppressor.
We would much rather be a few days late and do it correctly than be a few hours early and find out later that something was handled incorrectly.
This does NOT mean we believe suppressors will continue requiring the traditional Form 4 process. Quite the opposite. We are optimistic about where this is headed. We simply need clear guidance establishing the proper procedure for our store before we begin 4473-only transfers.
We are watching this extremely closely and communicating with the appropriate industry resources. The moment we are confident that we can legally and properly conduct these transfers, we will do it.
And when that happens, trust us — you won't have to wonder. We will let everybody know. Until then, please have a little patience with us and with our employees. This situation is changing literally by the hour, and there is a tremendous amount of information — and misinformation — circulating online.
We want the exact same thing you do:
Walk in. Pick out your suppressor. Complete the required background check and paperwork. Walk out with it.
We just want to make absolutely certain we're doing it right.
