🇺🇸 THREE MAJOR SECOND AMENDMENT DEVELOPMENTS IN JUST THE LAST FEW MONTHS!

If you haven’t been paying attention to what’s happening with federal fi***rm laws, now is the time!

From suppressors to handgun purchases for young adults and buying fi****ms across state lines, several significant legal developments could change how Americans purchase and own fi****ms.

Here’s what you need to know. 👇

🔴 1. SUPPRESSORS & THE NATIONAL FI****MS ACT (NFA)

An August 5 federal court ruling found that certain NFA registration and approval requirements could no longer be justified under Congress’s taxing authority after the elimination of the applicable making and transfer taxes.

The ruling addresses suppressors, short-barreled ri**es, and short-barreled sh****ns.

IMPORTANT: The injunction is limited to the covered plaintiffs, members, and customers. It does NOT automatically eliminate NFA requirements for everyone nationwide.

🔴 2. HANDGUN PURCHASES FOR ADULTS AGES 18–20

On September 18, the Department of Justice announced its legal conclusion that the federal prohibition on licensed dealers selling handguns to otherwise law-abiding adults ages 18–20 is unconstitutional and cannot be criminally enforced.

This is a significant change in federal enforcement policy, but it is not a Supreme Court ruling or a repeal of the statute.

At P&D, we’re watching for ATF and FBI/NICS processing guidance before changing our counter procedures.

🔴 3. PURCHASING HANDGUNS ACROSS STATE LINES

A September 18 federal appeals court decision addressed the longstanding federal restrictions on direct handgun sales to residents of other states.

The decision raises important questions about interstate fi***rm commerce and what purchasing procedures may look like moving forward.

However, this does not mean every interstate fi***rm transaction is automatically permitted without regard to applicable laws and dealer requirements.
