IPlax.com One of the most misunderstood aspects of the U.S. patent process is the initial rejection of a patent application. Many inventors are surprised, and even discouraged, when they receive a notice that their application has been rejected. However, this is actually a routine part of the process. In fact, most patent applications are initially rejected at least in part.

While there are many technical reasons why the U.S. Patent and Trademark Office (USPTO) may reject a claim, the most common involve prior art—previous patents or publications that disclose similar inventions. In particular, the examiner may determine that the invention, as described in the claims, is either:

Anticipated by prior art (meaning it was already publicly disclosed); or

Obvious in light of what was already known (a combination of earlier ideas that would be easily inferred by someone skilled in the field).

These types of rejections are issued under Section 102 (for anticipation) or Section 103 (for obviousness) of the U.S. patent law. For more information, check us out at IPlax.com
