Shield A Division of Massmart Wholesale COMPETITION 2023
Terms and Conditions
1. The Promoter is Shield a Division of Massmart Wholesale (“the Promoter”).
2. The “Shield A Division of Massmart Wholesale” (“the Competition”) will commence on 1 September 2023 at 00h00 and will end on 30 November 2023 at 23h59 (“Competition Period”). All members with the required growth based on the participating suppliers’ turnovers will be entered into the competition
3. The Competition is only open to the Shield A Division of Massmart Wholesale members, whose accounts, if applicable, are current and in good standing at the date of draw (“the Participants”). Employees, directors, members, partners, agents or consultants of the Promoter or its affiliates, their immediate family members, life partners, business partners and associates, and any persons directly or indirectly affiliated with the Promoter, or any persons directly or indirectly involved with the devising, production, management or marketing of the Competition are not eligible to participate in this Competition.
4. By entering the Competition, the Participants accept these terms and conditions (“the Rules”) and agree to abide by them. Any Participant may request to be furnished with a copy of the Rules at no cost by emailing such request to Natasha.Dathoo .co.za.
5. Participants agree and understand that they stand a chance to win their share of R150 000.00 (One Hundred and Fifty Thousand Rand) (“the Prize”), which will be credited to the member’s account. The Promoter reserves the right to exchange the Prize for one of equal or greater value, should the circumstances require this. There will be 3 (Three) winners in each of the 4 (Four) regions, resulting in a total number of 12 (Twelve) winners, 1st Prize R 80 000.00 (Eighty Thousand Rand), 2nd Prize R 40 000.00 (Forty Thousand Rand and 3rd Prize R 30 000.000 (Thirty Thousand Rand) for each region
6. Eligibility to enter the Competition:
6.1 A Participant is required to grow suppliers’ invoiced sales by showing a 20% (Twenty Percent) growth when compared with the invoiced sales during the period of September 2022 to November 2022. Only 1 (One) entry can be earned for each supplier of the Participant showing the requisite 20% (Twenty Percent) growth. An additional entry can be earned if the member achieves a 20% growth of the combined total of all Participating Suppliers.
1.1. New members purchasing from Participating Suppliers are eligible to gain an entry into the Competition.
1.2. Current members who are first time purchasers of Participating Suppliers are also eligible to gain an entry.
1.3. Members can receive a total of 12 (Twelve) entries into the Competition.
1.4. Participants must purchase from any or all of the below Participating Suppliers:
1.4.1. Pioneer Foods - Groceries Bokomo;
1.4.2. Culinary A Division of Tiger Brands Ltd;
1.4.3. Simba;
1.4.4. Diplomat Mondelez;
1.4.5. Danone;
1.4.6. RCL Foods – Grocery;
1.4.7. Tiger Consumer Brands Snacks & Treats
1.4.8. Tiger Consumer Brands Beverages;
1.4.9. Siqalo Foods;
1.4.10. National Brands Ltd; and
1.4.11. Nestle.
(“Participating Suppliers”)
7. Qualifying entry to the Competition shall be by means of a Participant:
2.1. Purchasing from the aforementioned Participating Suppliers and growing any one of the suppliers, by 20% compared to the same period (September, October and November) during the previous year.
2.2. New members and current members who became members after November 2022 or who are first time purchasers, shall have a valid qualifying entry when they purchase from the abovementioned Participating Suppliers during the Competition Period.
8. Any abnormal returns that were part of the purchases would negatively impact calculations for a three-month period after the closing date of the Competition.
9. The winners per region shall be the first qualifying entries, randomly drawn by way of a draw which will be held, at the earliest, on 14 December 2023, but by no later than 3 (Three) months after conclusion of the Competition. An independent party will be appointed to action the draw and, except in so far as is provided for in the Consumer Protection Act 68 of 2008, his/her decision will be final and no correspondence will be entered into in this regard.
10. The winners will be telephonically contacted on the contact number as captured on the member’s account within a reasonable time period after the draw.
11. The winners, by furnishing the Promoter with the required documents, consent to the Promoter utilising and processing their personal information strictly for the purposes of the Competition, in compliance with the Protection of Personal Information Act 4 of 2013.
12. Should any winners not be able to comply with the above requirements or if after any and all reasonable steps are taken in order to contact the winners, and if the winners cannot be contacted within the prescribed period of time, then the winners will be automatically disqualified and a second draw will be held where the procedure as set out above will be repeated.
13. Participants enter the Competition entirely at their own risk. The Promoter and its directors, affiliates, members, partners, employees, agents, consultants, suppliers and contractors cannot be held responsible or liable for any accident, injury, harm or loss suffered by any person or entity as a direct or indirect result of entering the Competition or suffered as a direct or indirect result of the utilisation in any way whatsoever of the prize won in terms of the Competition.
14. Participants hereby agree to release and indemnify the Promoter and its directors, affiliates, members, partners, employees, agents, consultants, suppliers, contractors and subsidiaries and hold it harmless against any and all losses, harm, damages, rights, claims and actions of any kind in connection with the Competition, promotion or special offer or resulting from the participation in the Competition or acceptance, possession, use or receiving of any prize relating to the Competition, including, without limitation, personal injuries, death and property damage, and claims based on publicity rights, defamation or invasion of privacy.
15. The Prize is not transferable and cannot be deferred and will be credited to the members account.
16. Should a Participant elect to receive marketing material, the Participant hereby opts in and consents to the Promoter processing the Participant’s personal information for purposes of marketing to the Participant with the understanding that the Participant may opt out at any time thereafter by emailing such request to [email protected].
17. The winners will be required to sign an acknowledgement of receipt of Prize and may be requested to be photographed and identified in any media, which is inclusive of but not limited to television, radio, print publications and online sites in which the Competition receives exposure and for future marketing initiatives with the understanding that the winner may decline such an invitation.
18. The artwork is for illustrative purposes only. The Promoter reserves the right to amend the Competition Rules if such amendment is necessary from a practical or fairness point of view. The Promoter shall have the right to terminate the competition immediately and without notice for any reason beyond its control requiring this. In the event of such termination, all participants agree to waive any rights that they may have in terms of this Competition and acknowledge that they will have no recourse against the Promoter, its agents and staff.
19. The above Rules are severable. This means that if any one rule is found to be unlawful, it will be removed and the remaining Rules will still apply.
20. Any violation or attempt to violate any of the above Rules will result in the immediate disqualification of the Participant.
